Chairman, Exam. Sub-Committee v. Choudhury Satyaranjan Samal, (SC) BS197046
SUPREME COURT OF INDIA

Before:-M. Jagannadha Rao and M.B. Shah, JJ.

Civil Appeal No. 161 of 1997. D/d. 21.11.2000.

Chairman, Exam. Sub-Committee & Anr. - Appellants

Versus

Choudhury Satyaranjan Samal - Respondent

Education - Re-valuation and Rechecking of Examination Papers

ORDER

This appeal is preferred by the Chairman, Examination Sub-Committee of the Joint Entrance Examination (E & M) 1995 and Indira Gandhi Institute of Technology, Saranga, Orissa.

2. The writ petition was filed by the respondent in 1995, seeking re-valuation and re-checking of the examination papers. The High Court rejected the said request. Having rejected the same, it also went on to make certain observations with regard to publication of model answers in future. It is against these observations that the appellant has come up in this appeal.

3. Having noticed the observations of the High Court, we are of the view that the observations were made not as directions, but only as recommendations to the appellant to consider the same. Inasmuch as no binding directions have been issued by the High Court and the observations are in the nature of the recommendations, we do not think any further orders are necessary in this appeal.

4. The appeal is disposed of accordingly. No costs.

Appeal disposed of.
