ORDER

Heard learned Counsels for the parties.

Learned Counsel appearing on behalf of respondent-Union of India has produced an additional affidavit wherein it has been stated that the Department has calculated the dues, amounting to Rs. 9,542/- which the petitioner was required to pay as normal rent for occupying the premises without any penalty from 1st January, 1991 to 31st December, 2000, i.e. the date on which he has handed over the possession of the premises. In the affidavit it has been stated that the petitioner's qualifying service is taken into consideration and the revised pension has been fixed accordingly and the arrears of pension have been credited to the account of the petitioner in the concerned Bank. He also submits that, as a special case, on the recommendations made by this Court penalty for occupying the premises is waived. He also submits that if any further amount is due to the petitioner, the same will be released as early as possible. In this view of the matter no further order is required to be passed in this matter and the same is disposed of accordingly.
