JUDGMENT
A.P. Misra, J. - Delay condoned. Leave granted. Heard learned Counsel for the parties. The grievance of the appellant is, the matter is pending in the Delhi High Court since 1990. The short question raised is, whether in view of the various agreements signed between the parties, the ICC, Paris has the jurisdiction for arbitration or as submitted by the respondent, a Judge of Indian Court be appointed a Arbitrator. 2. On the facts and circumstances of this case, we would not like to enter into merit of the contention as the matter is still pending adjudication in the High Court. On behalf of the respondent, the submission is, this long delay is also on account of the reason that the parties desired to settle their dispute which was not to be. Now both the parties are agreed that this matter may be disposed of expeditiously. This Court has been saying repeatedly : specially matter in arbitration should proceed expeditiously otherwise the very objective is lost. So we do request the High Court to dispose of this matter expeditiously. 3. We are informed by the parties, the next date fixed in this case in the Delhi High Court is 8th January, 2001. The parties agree they would not seek any adjournment and will cooperate in the matter. In view of this we hope and trust, the High Court will take up this case on the said date and dispose it of preferably within a period of four months from that date. 4. With the said observations, the present appeal is finally disposed of. Cost on the parties. .
