ORDER
Leave granted. The notice on the special leave petitions stated that the matter might be disposed of at this stage by setting aside the orders under challenge and restoring the writ petition to the file of the High Court to be heard and disposed of on merits. 2. The appellant was the writ petitioner before the High Court. By an order made on 24th August, 1999 the writ petition was fixed for hearing in the week commencing 25th October, 1999. The order granted stay of recovery conditional upon the appellant depositing a sum of Rs. 1,10,000/- on or before 30th September, 1999. Thereafter, the appellant moved an application in the writ petition alleging that the second respondent had declined to accept a Bank Draft in the sum of Rs. 1,10,000/- within the permissible time. The application sought directions to the second respondent to accept the same. In this application the order under challenge was passed. It said that the case of the appellant should be considered sympathetically by the respondents if the appellant applied for the same immediately on deposit of Rs. 1,10,000/-. It also gave certain other directions. The appellant moved an application for rectification of this order, which was rejected. 3. The complaint of the appellant is that at no stage were the merits of the writ petition considered and, in fact, it was disposed of earlier than the date on which it had been fixed for hearing. 4. Certainly, if appears that the merits of the writ petition have not been taken into consideration. We, therefore, deem it appropriate to set aside the orders under challenge and restore the writ petition (W.P. No. 35543/99) to the file of the High Court to be heard and disposed of on merits. This shall be done expeditiously. The appellant shall be at liberty to move the High Court for interim relief. 5. Order on the appeals accordingly. 6. No order as to costs. Appeal Ordered Accordingly.
